1. INTRODUCTION

1.1    Welcome. Welcome to CARLS Official online merch store. This document sets forth the terms, policies, and conditions that govern your use of this website and your purchase of merchandise, including apparel, accessories, collectibles, and other branded products offered through this store. Please be aware that our merchandise is produced and fulfilled through third-party production and fulfillment partners. We curate all original designs and manage the overall customer experience, while the physical production, printing, and shipping of products are handled by our trusted fulfillment providers.

1.2    Acceptance of Terms. By accessing, browsing, or placing an order through this website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Policies in their entirety. If you do not agree with any part of these terms, please do not use this website or make any purchases.

1.3    Effective Date. These Terms and Policies are effective as of April 15, 2026.

1.4    Updates and Modifications. We reserve the right to update, modify, or revise these Terms and Policies at any time. When changes are made, we will update the "Last Updated" date at the top of this document. Material changes will be communicated to customers via email or a prominent notice on the website. Your continued use of the site following any such changes constitutes your acceptance of the revised terms.

2. SHIPPING POLICY

2.1    Domestic Shipping (United States). All orders are produced and shipped by our third-party fulfillment partners from their production facilities, which may be located in various regions across the United States. Shipping rates and delivery estimates are calculated at checkout based on your location and the fulfillment center from which your order ships. Standard domestic orders are typically delivered within 5–10 business days after production is complete.

2.2    International Shipping. We ship to select international destinations. International shipping rates and estimated delivery times vary by country and are calculated at checkout. International orders may ship from different fulfillment centers depending on product availability and your location. Please note that international shipments may take longer due to customs processing.

2.3    Processing Times. Because all merchandise is made to order using print-on-demand production, each item is produced individually after your purchase is placed. Standard production and printing time is 3–7 business days before shipment. Limited-edition or specialty items may require additional production time, which will be noted on the product listing. Processing times do not include weekends or holidays.

2.4    Carriers and Tracking. Shipping carriers are selected by our fulfillment partners and may vary by order depending on the production facility and destination. Once your order has shipped, you will receive a confirmation email containing your tracking number and a link to track your package.

2.5    Shipping Costs. Shipping costs are calculated at checkout and are based on the delivery destination, order weight, and selected shipping method. Promotional free shipping offers may be available from time to time and will be clearly communicated on the website.

2.6    Customs, Duties, and Import Taxes. International customers are solely responsible for any customs duties, import taxes, brokerage fees, or other charges imposed by their country of destination. These charges are not included in the item price or shipping cost and are the responsibility of the buyer.

2.7    Delivery Delays. While we strive to ensure timely delivery, we are not responsible for delays caused by fulfillment partner production schedules, carriers, weather conditions, natural disasters, customs processing, or other circumstances beyond our control. We encourage you to contact our customer support team for updates on delayed shipments.

3. RETURNS POLICY

3.1    Return Window. We accept returns within 30 days from the date of delivery. To be eligible for a return, the request must be initiated within this 30-day period.

3.2    Return Conditions. To qualify for a return, items must meet all of the following conditions:

  • The item must be unused, unworn, and unwashed.
  • The item must be in its original packaging with all tags attached.
  • The item must not have been altered, customized, or damaged by the customer.

Please note that because all items are made to order through our print-on-demand process, the return window and conditions may differ from traditional retail. We encourage you to review sizing guides and product details carefully before purchasing.

3.3    Return Shipping. The customer is responsible for all return shipping costs. To initiate a return, please contact our customer support team, who will provide return shipping instructions. Please note that items may need to be shipped to our fulfillment partner's facility rather than to the store directly. We recommend using a trackable shipping method, as we cannot guarantee receipt of items shipped without tracking. Return shipping costs are non-refundable.

3.4    Refund Processing. Refunds are coordinated between the store and our fulfillment partner, which may add processing time. Once the returned item is received and inspected, refunds will be processed within 7–10 business days. Refunds will be issued to the original payment method used at the time of purchase. Please allow additional time for your bank or payment provider to reflect the refund in your account.

3.5    Items Not Eligible for Return. The following items are final sale and cannot be returned or refunded:

  • Sale or clearance items.
  • Limited-edition or exclusive-release items.
  • Custom or personalized items.
  • Items that have been worn, washed, altered, or damaged after delivery.
  • Gift cards.

3.6    Defective or Misprinted Items. If you receive an item that is defective, damaged during production, or significantly misprinted, please contact customer support within 14 days of delivery with photos of the issue. We will work with our fulfillment partner to provide a replacement or full refund at no additional cost to you. You will not be required to return defective or misprinted items.

4. EXCHANGES POLICY

4.1    Exchange Window. We accept exchanges within 30 days from the date of delivery. Exchanges are available for a different size or color of the same item, subject to product availability.

4.2    Exchange Process. Because all items are made to order, exchanges are handled as a new production order rather than a traditional swap. To initiate an exchange, please follow the steps below:

(a) Contact our customer support team via email to request an exchange and specify the desired size or color;

(b) Ship the original item back to us in its original condition and packaging using a trackable shipping method; and

(c) Once we receive and inspect the returned item, a new replacement item will be produced by our fulfillment partner and shipped to you.

4.3    Unavailable Exchange Items. If the requested size or color is no longer available at the time we receive your return, we will contact you to offer either a store credit for the full value of the item or a refund to your original payment method.

4.4    Exchange Shipping Costs. The customer is responsible for the cost of return shipping when initiating an exchange. We will cover the cost of shipping the replacement item to you via standard shipping. Please note that because a new item must be produced through our print-on-demand process, exchange fulfillment may take longer than a standard reshipment.

5. PRIVACY POLICY

5.1    Information We Collect. When you visit our website or place an order, we may collect the following types of personal information:

  • Identity Information: Full name, email address, phone number.
  • Shipping Information: Mailing address and delivery instructions.
  • Payment Information: Payment information processed through Shop Pay (powered by Shopify). We do not collect, process, or store your payment card details directly — all payment data is handled exclusively by Shopify's secure platform.

6. PAYMENT PROCESSING

6.1    Accepted Payment Methods. All purchases on this website are processed exclusively through Shop Pay, powered by Shopify. Shop Pay supports major credit cards, debit cards, and installment payment options through its platform. The store does not accept payments directly — all customers check out via Shop Pay as the sole payment interface.

6.2    Secure Processing. Shop Pay is built on Shopify's PCI DSS Level 1 compliant infrastructure, the highest level of payment security certification available. We do not process, store, or have access to full payment card details — all payment data is handled entirely by Shopify. Transactions are screened through Shopify's built-in fraud analysis and detection systems to help protect against unauthorized or suspicious activity.

6.3    Currency and Pricing. All prices listed on the website are in United States Dollars (USD). Prices are subject to change without prior notice, but changes will not affect orders that have already been confirmed.

6.4    Sales Tax. Applicable sales tax will be calculated and applied at checkout where required by law, based on the shipping destination of your order.

6.5    Order Confirmation. Upon successful payment, you will receive an order confirmation email summarizing your purchase, including the items ordered, total amount charged, and estimated processing time. This email serves as your receipt.

6.6    Order Cancellation by the Store. We reserve the right to cancel or refuse any order at our sole discretion, including but not limited to orders affected by:

(a) Pricing errors or inaccuracies in product descriptions;

(b) Suspected fraudulent or unauthorized transactions;

(c) Inventory or stock issues that prevent fulfillment; or

(d) Violations of these Terms and Policies.

If an order is cancelled, you will be notified promptly and a full refund will be issued to your Shop Pay account or original payment method linked to Shop Pay.

7. INTELLECTUAL PROPERTY

7.1    Ownership. All original designs, artwork, graphics, logos, music, photography, and branding content on this website are the exclusive intellectual property of the artist and brand. All rights are reserved. While base products (such as blank apparel and accessories) are manufactured by third-party suppliers, all designs, artwork, and graphics applied to those products are original creations owned exclusively by the artist. The use of third-party manufactured base products does not transfer any intellectual property rights to or from the product manufacturer.

7.2    Copyright Protection. All merchandise designs are original works of authorship protected under applicable copyright laws. These designs may not be reproduced, duplicated, copied, distributed, modified, or commercially exploited in any form without the prior written consent of the artist. Copyright protection applies specifically to the original designs and artwork created by the artist that are applied to merchandise, and does not extend to the base products themselves.

7.3    Personal Use Only. The purchase of merchandise from this store grants the customer the right to personal, non-commercial use of the product only. Purchasing an item does not transfer any intellectual property rights, reproduction rights, or resale rights to the buyer. Customers may not reproduce merch designs on other products, resell items at scale for commercial gain, or use product imagery for promotional purposes without written permission.

7.4    Reporting Infringement. If you believe that your intellectual property rights have been infringed upon by content on this website, or if you encounter unauthorized reproductions of our designs elsewhere, please contact us at the email address provided in Section 11. We take intellectual property matters seriously and will investigate all reported concerns.

7.5    Third-Party Product Marks. Base products used for merchandise may bear their own manufacturer brand names or trademarks (e.g., garment brand labels). These marks are the property of their respective owners and are used in the ordinary course of commerce. Their presence on merchandise does not imply endorsement, sponsorship, or affiliation between the manufacturer and the artist or brand.

8. USER CONDUCT

8.1    General Agreement. By using this website, you agree to use it only for lawful purposes and in a manner consistent with these Terms and Policies. You agree not to engage in any activity that disrupts, damages, or impairs the website or interferes with any other party’s use of the site.

8.2    Prohibited Conduct. The following activities are strictly prohibited:

9.3    Maximum Liability. In no event shall the total liability of the artist, brand, or store exceed the total amount you paid for the specific order giving rise to the claim. This limitation applies to all claims, whether based in contract, tort, strict liability, or any other legal theory.

9.4    Third-Party Services. We are not responsible or liable for failures, interruptions, errors, or delays caused by third-party service providers, including but not limited to third-party production and fulfillment partners, payment processors, shipping carriers, and web hosting services. Any issues arising from third-party services should be directed to the respective provider. Because products are manufactured by third-party partners, minor variations in print quality, color accuracy, garment sizing, and material texture may occur between production runs and are not considered defects.

9.5    Color and Appearance Disclaimer. We make every effort to display product colors and details as accurately as possible on our website. However, actual colors and appearance of merchandise may vary slightly from what is displayed on your screen due to differences in monitors, display settings, and lighting conditions. Additionally, because merchandise is produced using print-on-demand technology, colors and print quality may vary slightly between orders due to differences in production equipment, ink batches, and base product materials across fulfillment partner facilities. Such variations do not constitute a defect in the product.

10. DISPUTE RESOLUTION

10.1    Informal Resolution. In the event of any dispute, claim, or controversy arising out of or relating to these Terms and Policies, your use of the website, or your purchase of merchandise, we encourage you to first contact our customer support team directly. We are committed to resolving concerns promptly and fairly, and many issues can be resolved through direct communication.

10.2    Binding Arbitration. If a dispute cannot be resolved informally within 30 days of initial contact, the dispute shall be resolved through final and binding arbitration, administered in accordance with the rules of a nationally recognized arbitration organization. The arbitration shall take place in the State of Arizona, United States, and shall be conducted by a single arbitrator. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

10.3    Class Action Waiver. You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as part of a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against the artist, brand, or store.

10.4    Governing Law. These Terms and Policies, and any dispute arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict-of-law provisions.
